27th June 2009.

Dear Sir,

Thank you for your email dated 25 June in reply to mine of 24th.

This is a different matter and relates to your proposed scheme to provide employment by building a cycle way costing $50 million.
I would like to make a conditional offer to contribute $50 million of my own to this scheme, provided you can assist me to get recognition of my claim to ownership of Dragon and Sun brands (in China), which will enable me to personally receive the 300 million and $700 million U.S. which Microsoft agreed to pay to sun as a result of a court case in the California District Court in  2001.
The details, while they have not been put to the court in this country are not contentious, at least as far as my friends in China are concerned.
They are all here, but I do not see the need to print them out in full. Your officials can do that.

I have written to Tau Henare, and will send a copy of this to Pansy Wong M.P as she speaks Chinese, a prerequisite for understanding documents in Mandarin.
There are three brand name I am concerned about.
1/. One is Pall Mall or British American Tobacco from which I would like $50,000. This is my primary goal.
2/.The second is Sun and Microsoft, as Microsoft is now trying again to take over Sun, and hence the rights to the web browser and JavaScript, by way of a share-market takeover. This will not work because, as my web site points out, I claim to have written JavaScript, and the code was in the possession of the RAF long before Microsoft ever thought of it.
My claim to Dragon and Sun is inherited property, and although possession is mine, and may be disputed, it has already been accepted by reputable experts. Again, the details are documented on my web site.

Who is SUN?
"Sun is China's oldest international brand name for trading purposes, and was first recognized by India, in a deal in which both countries agreed to recognize the other's international boundaries."
It is owned by Dragon, the Imperial Dragon, or Emperor of China, like the British Monarchy is in England, but it is a recognised trade mark protected by the law of China. It is inherited property, and can be transferred (from one generation to the next).
Some would argue that Dragon and Sun no longer exist, but like "Phoenix", the mythical bird which rose from the ashes, and which represents the female side of the Emperor, or his wife, it does exist. So does Sun.
The graphic representation of the name sun is woven into the Imperial Emperors robe, which also has a word for "green fire which burns at 350 degrees" and has the ten navy's of China, including three navy's of Mexico, and three navy's of Africa, which no other country claims.
The Sun logo consists of a left handed and a right handed word Sun, in balance, the right handed one we know as the international symbol for fascism, the Nazi's and Adolf Hitler. The left handed word for Sun is also the word for Buddhist Martial arts and Buddhist Warrior Monks.
JavaScript is a trade mark belonging to SUN>

JavaScript is the language in which the web browser is written.

Who wrote it? I say I did, but Sun owns it.

Sun took Microsoft to court regarding ownership of Java, JavaScript and the right to distribute their software.

The summary of the lawsuit (dated January 23rd 2001) is on this page:
http://java.sun.com/lawsuit/ and says "as part of the agreement, Microsoft has agreed to pay Sun $20 million, to accept Sun's termination of the prior agreement, and to a permanent injunction against unauthorized use of Sun's JAVA COMPATIBLE trademark". This takes effect in 7 years in 2008.
The latest press release from Microsoft and Sun is dated April 2nd 2004

The first part of the story is reproduced here.
SAN FRANCISCO, CA - April 2, 2004 - Microsoft Corporation (NASDAQ: MSFT) and Sun Microsystems, Inc., (NASDAQ: SUNW) today announced that they have entered into a broad technology collaboration arrangement to enable their products to work better together and to settle all pending litigation between the two companies. The companies have also entered into agreements on patents and other issues.

The agreements involve payments of $700 million to Sun by Microsoft to resolve pending antitrust issues and $900 million to resolve patent issues. In addition, Sun and Microsoft have agreed to pay royalties for use of each other's technology, with Microsoft making an up-front payment of $350 million and Sun making payments when this technology is incorporated into its server products

The RAF had JavaScript in 1978

Avionics:...................Smiths provide the Hudwac  (HUD/weapon-aiming computer) whose computer portion has 20k words and serves as a flexible generator of graphics and symbology for air/air or air/ground aiming. An 8k word computer ties the various units of the Navhars (Nav and heading/attitude ref system), a Ferranti unit which, to avoid alignment inaccuracy at sea, is no longer pure inertial but comprises a lower cost twin-gyro platform monitored by Decca 72 Doppler.

(Note)The (8) Reconnaissance Pod (camera) software is separate from the computer which operates the aircraft and weapons systems, and is written in JavaScript © to avoid accidental corruption of the aircraft systems when data is downloaded.

What I would like to point out is that the Timing System, (source code C) written i JavaScript is not part of the web browser or operating system. It has mouse controls with it (meaning you can click on the screen without using the keyboard, (even though Microsoft owns the ASCII code rights) and online if you have a JavaScript (SUN) capable legal web browser, which currently is being distributed free, but which I wish to charge $2,009 for, but cannot without a court order regarding my ownership.

November 17 1998 Teleconference Post Sun vs Microsoft Ruling

Chuck Jones: Two questions. First do you believe there is a way for Microsoft to leave their changes in their Java extensions and still pass the compatibility tests or must they remove them? Secondly, is complying with order good enough, such as shipping both their version and your version? Or are there additional dollar damages that you will be asking for?

A. Baratz: I'll address the first question. Then I'll ask Mike Morris to address the second question. We have said all along that we encourage our licensees and partners to innovate on the Java platform and to introduce new functionality to enhance that platform. However, we have always said that that innovation needs to be done in such as way that the resulting functionality adheres to Sun's applet application program interface and passes our compatibility test suites. To that end, we are not asking Microsoft to remove any enhancements that they might have added that do not interfere with Sun's public interfaces to the Java technology. All we're asking is that they fully support Sun's public interfaces to the Java technology and pass the compatibility test suite that tests for such adherence. So long as they do that, we achieve cross-platform support, we achieve the ability for Java applications to run across multiple operating systems and multiple microprocessors. Beyond that, if a single partner or licensee wants to enhance the technology, they're free to do that.

A. Baratz: OK. They're really two different questions there. Regarding the first question, it's really-it's not applications that need to pass the job of compatibility test suite. It's products that incorporate the Java run-time environment that need to pass the Java compatibility test suite. These would be parts like operating systems or browsers or tools. (our emphasis) To date, we're in a situation where all of our licensees of the Java technology that incorporate the technology within their products, either pass the compatibility test suite or have committed within a specific timeframe to pass the compatibility test suite. At this point, Microsoft is the only company that is really out of compliance with the agreement and the requirement to pass the Java compatibility test.

The banking act is very simple.
The money in the bank belongs to the owner,
and the government has a legal responsibility under its own legislation to that legal owner, whether or not the money has already been paid out to someone else in negligence (unknowingly) or through a deliberate fraud.

How can these experts say they did not know something when there is a public record of what they knew, and when they knew it, whether or not the believed the truth of what they were being told? Perhaps they simply chose to believe what they wanted to believe, perhaps because they benefited financially from that interpretation of the facts, no matter what the facts and the truth really are.

Thank you again for your time which I realize is valuable, but I think you must also understand that the economic meltdown, although urgent, is not as serious as global climate change and warming. You already know my answer to that, and it is a 10% petrol surcharge. Perhaps when a fire breaks out in Sydney and millions are killed you will take it seriously? Hopefully if the expected earthquake has not hit Wellington, you will be able to assist if the worst happens.

Yours sincerely,
Malcolm Baker.

I have included some details of the costing of the cycle way as it relates to our area, for your officials to consider.
People I spoke to say the answer is not minimum wages. Already people are trying to survive working 70 hours per week for $13.50 per hour, but it makes life miserable for them. You should consider the option at least of employing 1 in 4 at the rate of $20 per hour as supervisors.

From Environment BOP
"This report outlines the Kaituna Maketu Joint Council Committee response to your feedback.
The Strategy has been approved by Environment Bay of Plenty and it is currently being considered by Western Bay of Plenty District Council, Tauranga City Council and Rotorua District Council.  Once it has been approved and published, you will be posted a copy."

To Michelle Lee
Environment Bay of Plenty
We are now trying to get funding to build some of the cycle ways the government is talking about.
Have you any information about these.

We have been planning a cycle way from Te Puke to Papamoa, with a pedestrian and bicycle path across the Kaituna River on the new bridge, which will enable cyclists to travel from Papamoa to either Te Puke or Maketu (and on to Rotorua), if and when it goes ahead.

I have calculated that two grades of aggregate will be needed, if the cycle way is gravel but not concrete or sealed with bitumen, one for the base, and a finer grade for the surface.
It will have to be compacted, but I'm not sure about existing engineering designs.

This means 50% of the money approximately will go on materials, and 50% on wages.

It should be fairly simple to calculate the cost, once the price of the aggregate has been established, by calculating for a given with of path (wide enough for two people cycling side by side to pass one coming in the opposite direction.
So for 2 metres wide by 300 mm deep + 100 mm of a finer gravel (or whatever the dimensions are finally determined to be) will be the material cost for 100 metres, and labour will be an hourly rate ($13.50 to $19?) with teams using mechanical means to cut the  foundations down to the clay (30 cm? more?- engineers will have to be consulted)  and possible some tools can be supplied by local councils if the government is prepared to fund that.
Thus 10m of foundation track for every cu meter coarse gravel, and 100 m for every cu m of fine chip, (or whatever).

Thanks again, I look forward to our next meeting.
